Terms and Conditions


Please read the below details before you place a deposit on a Puppy with us. The purpose of this contract is to protect the buyer and the seller, and set a transparent pathway for any concerns or disputes should they arise.


It is recommended that the buyer carries out all due diligence prior to purchasing a Bulldog Breed as there are known health conditions that are common in this breed that could potentially affect the quality of life of this animal.  It is accepted that upon purchasing a bulldog from us, you have done your research and are well aware of the associated health risks in owning a Bulldog.

Puppy Purchase / Sale Contract


We sell this puppy, feeling in good faith it is a healthy and respectable complement of its breed. We hereby acknowledge this to be a true and binding contract. We agree, and make an absolute promise, to fully abide by its terms and conditions.



1.    Terms of Purchase


1.1   Cooling Off / Change of mind:

The Buyer has 5 days after the purchase of the puppy to return the puppy if they change their mind or no longer want to proceed with ownership of the puppy.  If the buyer chooses to return the puppy under this agreement, then they will forfeit their deposit and be refunded 90% of the purchase price. If at any point the seller deems the buyer unsuitable to purchase a puppy, the buyer will notify the seller and refund 100% of the deposit.  The Seller has no obligation to sell a puppy to any individual if they do not wish to.

2. Health Report after purchase

2.1  The buyer agrees to have the dog examined by their veterinarian at their expense within 5 working days from the date of purchase and report must be emailed to the Seller, failure to do so will void the health guarantee. There are no requirements from the seller as to what tests are performed.  The vet / health tests that the buyer chooses to perfom on the puppy is at the discretion of each buyer and how in depth they want the report to be, the vet report is to help satisfy the buyers independent decision to determine the health of the puppy. If the buyer is not satifisfied with the the vet report or the health of the Puppy they must return the puppy to the Buyer at their expense for a full refund within 10 Days.


3. 12-Month Health Guarantee:

The seller certifies that, upon receipt, the dog is in good health and has been vaccinated, microchipped, and wormed according to the accompanying health record of said Bulldog. 


3.1   The puppy is guaranteed for (1) year against the following fatal and life-altering diseases that adversely affect the health of the animal. This guarantee will only cover the following:

  • Severe hip dysplasia (which hampers the dog's movement and natural gait and which requires surgery to correct)
  • Kidney problems of a severe, life-threatening, or altering nature.
  • Heart problems of a severe, life-threatening, or altering nature.
  • Pancreas problems of a severe, life-threatening, or altering nature.
  • Spine problems of a severe, life-threatening, or altering nature.
  • Liver problems of a severe, life-threatening, or altering nature.



3.2   If the dog dies from a health related issue within a 1-year time frame, the buyer must pay to have the animal autopsied to determine the reason. A replacement will only be offered if the death is a result of a condition as outlined in section 3.1. 


3.3   The seller reserves the right to a second veterinarian's opinion at the expense of the seller. Shipping the puppy back is at the seller’s expense. 


3.4   If the sold Puppy is diagnosed with one of the above-listed conditions in section 3.1, the Seller will replace the puppy from another litter when available. The replacement puppy will be of the same value, colour, and temperament if and where possible. There may be a wait-time involved to receive a replacement puppy, the buyer cannot guarantee the timeframe of a replacement puppy. 


3.5   Every effort has been made to ensure that your puppy is as healthy as possible. However, bulldogs are prone to multiple health problems that are breed-related. This Health guarantee DOES NOT cover what in the bulldog breed is considered normal: 

  • Cherry eye
  • Entropion
  • Skin allergies
  • Elongated soft palate
  • Stenotic nares
  • Over-heating or heat exhaustion
  • Drowning
  • Pneumonia or Aspiration Pneumonia
  • Eating Disorders
  • Vomiting and Regurgitation


3.6   Any condition caused by an injury or illness after the new owner takes possession is not covered, these include:

  • Environmental issues related to injury from rough play or excessive jumping from heights at a young age
  • Over-feeding or obesity. 
  • Choking
  • Ingesting foreign objects
  • Parvo, CHV, Kennel cough, or other relatable Airborn or pathogen-based virus. 

Contagious canine diseases.  Please remember that immunity from infectious diseses such as parvo and kennel cough is not obtained untill after the 3rd vaccine, we have protected your puppy from these dangerous viruses and ask that you do the same, by not taking your puppy to public places untill they are fully vaccinated.


3.7  If a puppy is found to have a Life threatening health problem as indicated in section 3.1 that warrants its return, the buyer's vet must send a certified letter that’s signed and dated with the said non-treatable defects/illness. The letter must include the vet’s name, address, and telephone number. The Letter must then be emailed to the Seller nzrarebulldogs@gmail.com 


 

4.   The buyer agrees to the following

  • To house the bulldog puppy appropriately in a clean, climate-controlled environment
  • To provide all vaccinations (parvo and kennel cough), worming, heartworm prevention
  • To socialise the puppy
  • Provide necessary vet care when needed
  • Provide quality Puppy food for the first 12 months, with 24/7 access to  filtered freshwater. 
  • Keep the puppy adequately and mentally exercised up to 20 minutes daily
  • Keep the puppy cool in summer, and warm in winter
  • Do not let the puppy near deep water at the risk of drowning as bulldogs CANNOT SWIM
  • Not to feed treats, bones or food that poses a choking hazard
  • Not allow the weight of the Puppy to exceed 25kg in female, and 30kg in males
  • Take precaution when puppies are eating too fast (use a slow feeder)
  • Dont allow puppies to play in or near water, or liquid substances to minimise risk of aspiration (enhaling of liquid into the lungs)


4.1   Failure to comply with section 4. will void the health guarantee. 

4.2   Your Puppy will have received the following:

  • Vet check at 7 weeks (Limb flexing, heart murmur, breathing, vigor)
  • 1 vaccine
  • Wormed at 4,6,8 weeks of age
  • Nexguard Spectra (fleas, ticks, worms) 1 month cover
  • Microchip insertion (The buyer must register the chip with their vet)

 
5.0   This guarantee applies to the original buyer only, and cannot be transferred to a second buyer or owner. Any disputes must be handled in New Zealand at buyer(s) expense. Any changes to this contract must be in writing and agreed to and signed by both parties. 


5.1   Buyer agrees NOT to sell this dog to any 3rd party,retail company or establishment. 


5.2    This contract is legal and may be enforced by legal means at the buyer’s expense and all disputes must be settled in Whangarei, NZ.


5.3   In the event that litigation is commenced to enforce any of the terms of this Agreement the breeder, being (Chala Chase), shall be entitled to the costs thereof, including reasonable attorney's fees and expenses.


5.3   The buyer(s) agree never to abandon, onsell or surrender the dog to an animal shelter, rescue group, or another similar facility, or person without at least first attempting to contact the seller/breeder to make other arrangements for the dog.

 

6.   Pet Provision - Desexing agreement

Said bulldog puppy will be sold as “Pet Only” to the Purchaser. This means that the Dog is marked “Not for Breeding” and must not be bred from at anytime.


6.1   This dog must be (spayed/neutered).

 

6.2   Proof of spay/neuter must be sent to the breeder in the form of a copy of the spay/neuter certificate issued and signed by the Buyer's Veterinarian. (scanned images or photos must be sent via email) to nzrarebulldogs@gmail.com

 

6.3   Failure to Comply with Pet Provision

In the event that the owner breeds, or attempts to breed, this dog, the Breeder has the right to assume legal custody of the dog, including all papers, without any reimbursement to the owner. 


6.4   The owner hereby agrees to also forfeit every puppy from any litter, that a bitch may be carrying, All puppies will then be spayed/neutered and placed into a home chosen by the breeder. Any and all profit from sales of such puppies shall be donated to a local animal shelter.

In the case of a Male/Sire - All monies made from stud fees must be paid in full to the seller, and the buyer will forfeit all income/profits made by said Male/Sire. Monies will then be donated to a local animal shelter.

7.   Pet Insurance

We offer a complimentary 6-week insurance policy with Pet Plan, this is a comprehensive policy that is optional to continue on with after the free 6-week period.

We also encourage you to shop around to find the best policy that suits you after this trial period.

Pet insurance may not cover all bulldog hereditary issues so be mindful of this when you make your inquiries.  As a general rule if the issue results from trauma or an accident it will in most cases be covered.  Also, be mindful that any pre-existing issues will not be covered.

There is a 10 Day waiting period on all claims. 

 
8.   Pickup and Transport

Your Puppy will be ready to be picked up at 8 weeks of age (no earlier).  The Seller will organise a date (usually a weekend) and contact you to organise pickup.


8.1   The Seller can also organise Air or Road transport for an additional fee. An estimate for flights ranges from $360-$480.

Pickup is from Ruakaka, Northland, and the address will be provided at a later date.


8.2   Pre-visits or Home Visits.  The Buyer does not allow visits to their property as they pose a number of risks which include, Contagious canine diseases, risks of theft of our breeding dogs, and so on and so forth. All inspections and interactions will be performed via video calls, photos, phone calls or digital correspondence. This is not up for negotiation.



9. LIMITATIONS OF GUARANTEE: We do not guarantee the adult colour, the adult size, conformation, reproductive ability, show quality, testicles descending, retained teeth, personality, ear standing, potty training ability, proper bite, coat quality,coat  length, personality, weight, hernias of any kind, physical flaws or the temperament of the puppy. This guarantee does not cover common conditions and is limited only to defects largely considered life threatening.  The seller is not responsible for any veterinarian bills incurred once the puppy is purchased; the buyer assumes all responsibility for the puppy. Buyer understands that adult sizes are an estimate only, based on the seller's experience. Buyer acknowledges that there is no guarantee on final adult weights, actual size or color. This guarantee does not cover any veterinarian costs associated with spaying or neutering, including undescended testes. We do not warrant any condition caused by carelessness, negligence, or abuse. It is understood that the buyer has carried out research into this breed and is aware of all the common known health issues relevant to the breed. 

The puppy is being sold in an “as is” condition and the breeder expressly disclaims all warranties, other than that the puppy is fit and healthy at the time of sale whether expressed or implied. The buyer understands and agrees to this.
